These Terms and Services ("Terms") govern your access to and use of the websites, forms, marketing materials, and related online services operated under the manhattanplasticsurgerypllc.com domain and branded as AutoGuard Warranty (collectively, the "Services"). By visiting our website, submitting a form, requesting a quote, or enrolling in an extended service contract administered through our programs, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services.
"AutoGuard," "we," "us," and "our" refer to the administrators of the AutoGuard Warranty program and affiliated marketing entities responsible for the website. "You" and "Member" refer to any visitor, prospective customer, or enrolled contract holder. "Contract" or "Policy" means the extended service contract, vehicle service contract, or similar agreement issued to you upon enrollment, which is governed primarily by the terms contained in that separate document. "Administrator" means the third-party obligor or insurance carrier identified on your Contract who is financially responsible for covered claims.
Our website provides educational content about extended vehicle protection, plan comparisons, sample pricing illustrations, and tools to request quotes or contact our team. Unless explicitly stated in a signed Contract, nothing on this website constitutes a binding offer of insurance or a guarantee of claim approval. Sample monthly prices, coverage summaries, and marketing descriptions are provided for general information and may differ from your final quote based on underwriting criteria, vehicle inspection results, and applicable regulations in your jurisdiction.
Extended service contracts are not manufacturer warranties. They are separate agreements that may overlap with remaining factory coverage for a period of time. You are responsible for reviewing your Contract, schedule of coverage, exclusions, deductibles, waiting periods, and cancellation rights before enrollment.
You represent that you are at least eighteen years of age and have the legal capacity to enter into a Contract. When submitting forms on our website, you agree to provide accurate, current, and complete information about yourself and your vehicle, including odometer readings, vehicle identification number, prior damage, modifications, and commercial use. Misrepresentation or omission of material facts may void coverage, result in claim denial, or constitute grounds for cancellation as permitted by your Contract and applicable law.
Quotes generated through our website or by email are estimates unless accompanied by a formal enrollment packet. Enrollment is complete only after you accept the Contract terms, pay required fees or establish a payment plan, and receive confirmation from us or the Administrator. Payment methods, billing cycles, late fees, and returned payment policies are disclosed during checkout and in your Contract. Failure to maintain payments may suspend or cancel coverage according to the Contract.
Covered components, labor rates, parts standards, rental benefits, roadside assistance, and trip interruption limits are defined exclusively in your Contract and any applicable riders. Common exclusions include maintenance items, wear-and-tear, cosmetic damage, pre-existing conditions, damage from abuse or racing, and failures caused by lack of maintenance unless otherwise covered. Waiting periods and odometer thresholds must be satisfied before claims are eligible.
To file a claim, you must follow the procedures in your Contract, which typically require obtaining authorization before repairs begin, using qualified repair facilities, and retaining diagnostic records. We and the Administrator reserve the right to inspect the vehicle, request maintenance history, and approve repair methods and parts. Unauthorized repairs may not be reimbursed.
We maintain relationships with participating repair shops and roadside vendors. While we encourage use of participating providers for streamlined payment, your Contract may allow non-participating facilities subject to reimbursement limits. We are not liable for the workmanship of independent repair facilities or for delays caused by parts availability, shop scheduling, or events outside our reasonable control.
Transfer of coverage to a new owner may be available for a fee if the transferee meets eligibility requirements. Cancellation rights, pro-rata refunds, and administrative fees vary by Contract and governing law. Details appear in your enrollment documents. Submitting a cancellation request through our website does not automatically terminate a Contract until processed and confirmed in writing.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. EDUCATIONAL ARTICLES ARE NOT LEGAL OR FINANCIAL ADVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOGUARD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR RELIANCE ON WEBSITE CONTENT. OUR TOTAL LIABILITY FOR DIRECT DAMAGES RELATED TO THE WEBSITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US FOR WEBSITE-RELATED SERVICES IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. CLAIMS FOR COVERED VEHICLE REPAIRS ARE SUBJECT TO YOUR CONTRACT AND THE ADMINISTRATOR'S OBLIGATIONS, NOT THESE WEBSITE TERMS.
You agree to indemnify and hold harmless AutoGuard and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of the Services, or misrepresentation of vehicle or ownership information.
These Terms are governed by the laws of the state identified in your Contract or, if none applies to website use, the laws of the state in which AutoGuard maintains its principal place of business, without regard to conflict-of-law principles. Disputes arising under these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration or courts as required by applicable law and your Contract. Class action waivers may apply where permitted.
We may update these Terms periodically. The "Last Updated" date reflects the most recent revision. Material changes will be posted on this page. Continued use of the Services after changes constitutes acceptance. For enrolled members, Contract terms control over conflicting website summaries.
Our collection and use of personal information is described in the Privacy Policy, which is incorporated into these Terms by reference.
